Terms of Service

Please read these Terms of Service carefully before using the Surlink platform.
1. Acceptance of Terms
- •By accessing or using the Surlink platform (surlink.app), you agree to be bound by these Terms of Service.
- •If you are using Surlink on behalf of a company, you represent that you have authority to bind that company to these terms.
- •If you do not agree to these terms, do not use the platform.
2. Services
- •Surlink provides a platform connecting US companies ("Clients") with pre-vetted Latin American professionals ("Candidates").
- •Surlink acts as an intermediary and talent placement service - we are not an employer of record.
- •Service availability is not guaranteed 24/7. We may perform maintenance that temporarily disrupts access.
3. Client Obligations
- •Clients must provide accurate and complete information when creating job offers.
- •Clients agree to treat Candidates with respect and in compliance with applicable law.
- •Clients may not contact Candidates sourced through Surlink outside the platform to circumvent our fees.
- •Clients are responsible for compliance with their local labor laws regarding contractor engagements.
4. Fees and Payment
- •Flat Fee model: a one-time fee of $3,000 USD is due upon confirmation of a hire.
- •Subscription model: $499/month per team member, billed monthly, plus a one-time $1,000 onboarding fee.
- •All fees are due within 14 days of the invoice date.
- •Late payments may incur a 1.5% monthly late fee.
- •Surlink reserves the right to update pricing with 30 days' notice.
5. 180-Day Guarantee
- •If a placed candidate leaves or does not perform within 180 days of their start date, Surlink will conduct a replacement search at no additional placement fee.
- •The guarantee applies to qualifying circumstances as described in our Guarantee Policy.
- •The guarantee does not apply if the engagement ends due to client-side restructuring, role elimination, or violations of the candidate's agreement.
6. Intellectual Property
- •Surlink owns all intellectual property rights in the platform, including its design, code, and content.
- •Clients retain ownership of their job offer content.
- •You may not copy, modify, or distribute any part of the platform without written permission.
7. Confidentiality
- •Candidate profiles and compensation information shared through the platform are confidential.
- •Clients agree not to share candidate information with third parties without Surlink's consent.
8. Limitation of Liability
- •Surlink is not liable for indirect, incidental, or consequential damages arising from use of the platform.
- •Our total liability in any dispute is limited to the fees paid to Surlink in the 3 months prior to the claim.
- •We make no warranties about candidate performance beyond what is stated in our Guarantee Policy.
9. Termination
- •Either party may terminate a subscription engagement with 30 days' written notice.
- •Surlink may terminate accounts that violate these terms without notice.
- •Upon termination, any outstanding fees become immediately due.
10. Governing Law
- •These Terms are governed by the laws of the State of Delaware, USA.
- •Any disputes shall be resolved through binding arbitration, except where prohibited by law.
